Terms of Service
The rules for the free audit, the checklist, and account access
1. Agreement
These terms cover your use of auditmydigitalagency.com and anything we provide through it, including the free audit and the downloadable checklist. Using the site means you accept them. If you do not, please do not submit a form.
Our Privacy Policy explains how we handle your information and forms part of these terms.
2. What the free audit is
An independent review of the SEO and/or Google Ads work currently being done on your behalf, delivered as a written document, normally within three business days of us having what we need.
It is free. There is no card, no contract, and no obligation to buy anything afterwards. We may offer a short call to walk you through the findings, and we may quote for fixing what we find, but you are free to decline both and keep the report.
3. What it is not
- It is not legal advice. If your dispute with an agency is heading somewhere legal, talk to a lawyer.
- It is not financial or investment advice.
- It is not an evidence report prepared for litigation and it is not written to a forensic or expert-witness standard.
- It is not a promise of results. We describe what we find. We do not guarantee that acting on it produces any particular outcome.
- It is not an accusation against any named third party. Findings describe the state of an account or website, not the intent of whoever worked on it.
We report what we find, including when we find that your current agency is doing a good job. We will not work backwards from a conclusion you have already reached, and we will not write something we do not believe in order to help you win an argument or a refund.
4. What we need from you
You agree that:
- The information you give us is accurate.
- You are authorised to request an audit of the website and accounts you submit, and to grant any access you grant.
- You will not submit a website or account belonging to someone else without their permission.
5. Account access
SEO audits are usually done from publicly available information. Google Ads audits require read-only access, which you grant and can revoke at any time.
We will use that access solely to prepare your audit. We will not make changes, we cannot spend your money, and we will not use your account data for any other purpose. We are not responsible for anything that happens in your account outside of our read-only review, including changes made by you, your agency, or Google's own automated features.
6. Your report
The report is yours. Keep it, share it internally, or hand it to your current agency and ask them to fix what it lists. That last one happens often and we have no problem with it.
We ask that you do not publish it publicly or present it as the work of someone else. We retain ownership of our underlying templates, methodology and materials.
7. The checklist download
The Agency Accountability Checklist is provided free for your own use inside your business. You may print it, fill it in, and share it with your team or your agency. Please do not resell it or republish it as your own work.
Download links are personal to the request and expire after seven days. Request another if yours lapses.
8. No guarantees
The audit reflects our professional opinion based on what we can see at the time we look. Advertising platforms and search engines change constantly, data is sometimes incomplete or wrong at source, and reasonable practitioners can disagree.
The site and everything on it is provided "as is", without warranties of any kind, to the fullest extent the law allows. We do not warrant that the site will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost data, or lost business opportunity, arising from your use of this site, the audit, or the checklist.
Because the audit is provided free of charge, our total aggregate liability to you in connection with it is limited to one hundred US dollars ($100).
Nothing here excludes liability that cannot lawfully be excluded.
10. Work we may decline
We may decline or stop an audit, without explanation and at any time, including where:
- There is nothing meaningful to audit yet.
- We believe the request is intended to build a case rather than get an honest answer.
- We do not have permission from whoever controls the account.
- There is a conflict of interest.
- The request is abusive, or aimed at a private individual rather than a business.
11. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. The courts of Texas will have exclusive jurisdiction, except where consumer protection law in your own country gives you the right to bring proceedings locally.
We may update these terms. The version published here at the time you submit a form is the one that applies to that submission.
